These Terms of Service ("Terms") are a binding agreement between you and Puff Geeks LLC ("Puff Geeks," "we," "us") governing your use of Puff Geeks vending machines, the Puff Geeks mobile applications, the web dashboard, and related services (together, the "Services"). By creating an account, making a purchase at a kiosk, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you are using the Services on behalf of a business (for example, as a machine operator), you represent that you have authority to bind that business, and "you" includes that business.
You must be old enough to form a binding contract in your jurisdiction to create an account. Certain products sold through our machines (for example, vapor products) are restricted by law to purchasers 21 years of age or older. Purchasing an age-restricted product requires passing identity/age verification at the machine at the time of purchase — every time, with no exceptions and no stored bypass. Attempting to obtain an age-restricted product for someone under the legal age is prohibited, is grounds for immediate account termination, and may be reported where the law requires.
You are responsible for the accuracy of your account information, for keeping your password confidential, and for activity under your account. Notify us promptly of any suspected unauthorized access. We may suspend accounts that show evidence of fraud, abuse, or a security compromise. Staff accounts (operator and employee roles) exist within an operator's team and are subject to the access the operator grants and revokes; removing a team member ends their access immediately.
Prices are shown before you pay and may vary by machine. Prices can also change over time at the same machine: an operator may enable demand-based pricing, which adjusts a product's price within limits the platform enforces, and operators may change their prices directly at any time. The price displayed to you at the machine or in the app at the moment you confirm is the price that governs that purchase; we do not reprice a transaction after you confirm it. Sales tax is added where applicable, and a card-processing fee is shown as its own line at checkout. Payment is authorized before the machine dispenses and captured only for what actually dispenses: if a product fails to dispense, you are not charged for it, and if nothing dispenses you are not charged at all (including the card fee). SAVED CARDS: you may choose to save a card to your account so you do not have to present it again. The card is stored by our payment processor, not by us — we keep only a processor token and the brand, last four digits, and expiry needed to show you which card you are using (see the Privacy Policy, Section 3). Saving a card authorizes us to charge it for transactions you initiate on your account, and for no other purpose. You can remove a saved card at any time from your account; removing it does not cancel charges already authorized or transactions already completed. HOW CARD PAYMENTS ARE TAKEN AT OUR TERMINALS: our machines use more than one kind of card terminal, and they do not all move money the same way, so it is worth knowing which you are looking at on your statement. On most of our terminals, and whenever you pay in the app with a saved card, we place an AUTHORIZATION (a temporary hold) for the maximum amount the transaction could come to, and then charge only the amount actually owed — the unused part of the hold is released by your bank, typically within a few business days, and never appears as a charge. Some of our terminals run on a card network service that does not support charging less than the amount authorized. At those terminals, the full amount is CHARGED at the moment you tap, and the difference between that amount and what you actually owe is REFUNDED when the transaction is settled. On that rail you will see a real charge and a separate refund on your statement rather than a hold that quietly disappears, the two may be days apart, and how quickly the refund posts is determined by your bank and card network, not by us. Either way, the amount you ultimately pay is the amount you were shown and actually owe; the difference is only in how your bank displays it along the way. If you believe you were charged incorrectly, contact support through the app — refunds for failed dispenses that our systems did not catch automatically are handled through support tickets. Except as described here or required by law, completed purchases of dispensed products are final.
The Services include a rewards program with three kinds of program credit: (a) Puff Points, earned at a flat rate per unit purchased (currently 25 points per unit); (b) reserve tokens, earned free through optional rewarded advertisements (limited per day) and purchase milestones, each worth one standard reservation; and (c) Pro tokens, obtained through a Pro subscription's recurring grant or individual purchase, which unlock Pro reservations. ALL program credits are promotional credits, not money: they have no cash value, are not redeemable for cash, are not transferable or salable, and are not a deposit or stored-value account. Balances are tracked in auditable ledgers visible in your account. We may modify earn rates, redemption prices, daily caps, and program mechanics prospectively, and will not retroactively remove credits you have already earned except in cases of fraud or abuse. Credits associated with an account are forfeited when that account is deleted.
A reservation holds a specific unit in a specific machine for a limited time in exchange for points, a token, or a small card fee, and provides a pickup code that lets you buy the held unit at that machine. A reservation guarantees the hold for its stated duration only: if you do not redeem it before it expires, the hold is released and the fee, points, or token you paid is the cost of the no-show. You may cancel an active reservation before expiry for a full refund of whatever you paid. Standard (non-Pro) reservations hold one unit for 30, 45, or 60 minutes. Pro reservations, paid with Pro tokens, hold one to three units for 60, 90, or 120 minutes on a published token price ladder.
When every remaining unit of a product is already held, a NEW Pro reservation may displace ("bump") at most one existing standard hold — but only one placed within the previous 15 minutes. Your first 15 minutes are therefore the only window in which a standard hold can be displaced; after 15 minutes, a standard hold cannot be bumped, and a Pro hold can never be bumped by anyone. If your hold is bumped: you are automatically refunded in full (points, token, or card fee); you automatically receive a bonus reserve token as a make-good; you keep priority — the system automatically places a new free hold for you on the next unit of that product that becomes available (for up to 24 hours); and the app tells you exactly what happened. If a Pro reservation finds no displaceable hold, it is simply rejected as sold out — a Pro token improves your odds on contested stock; it does not guarantee inventory that does not exist.
The optional Pro subscription bills monthly at the price shown in the app before you subscribe (currently $14.99 per month), grants a fixed number of Pro tokens each week while active, removes advertisements from your app experience, and includes an allowance of $1 all-day portable-charger rentals each month (currently six). Your first weekly token grant is issued immediately on subscribing. HOW THE FREE RENTAL ALLOWANCE WORKS: the allowance covers the RENTAL USAGE FEE only, on rentals you start in the Puff Geeks app while your subscription is active. It does not apply to a rental started by tapping a card at a machine, because that transaction is anonymous and cannot be matched to your membership. Whether a rental is covered is determined when the rental STARTS and is fixed at that moment, so a rental that begins while you have allowance remaining stays free even if it ends in a later month or after you cancel. WHAT "$1 ALL DAY" MEANS: a covered rental costs the card-processing fee only (shown to you before you confirm, currently $1.00) for up to 24 hours from pickup — the membership covers the rental meter for that day, not the cost of processing the card. If you keep the charger past 24 hours, each additional day begun is charged at the machine's standard day-pass rate, never exceeding the deposit. The allowance runs by calendar month and does not roll over; unused free rentals expire at the end of the month, and a covered rental counts against the allowance whether or not it ends in a normal return. IMPORTANT — A FREE RENTAL IS NOT A FREE CHARGER: the refundable deposit authorization taken when you rent, and anything owed if a charger is not returned, are NOT waived or reduced by this benefit and are governed by the separate rental terms presented to you at the time of rental. If your subscription is cancelled or its benefits are paused for non-payment, the allowance stops immediately and later rentals are charged at normal rates. YOU MAY CANCEL AT ANY TIME, IN THE APP, IN ONE STEP, and cancellation takes effect immediately: billing stops, future weekly grants stop, ads return, and you KEEP all tokens already granted. We do not claw back program credits on cancellation. If a subscription charge fails or is reversed, we may pause the subscription's benefits until payment is resolved. Individually purchased Pro tokens are charged at the price shown at purchase and are non-refundable once granted, except as required by law.
The Services display advertisements on kiosk screens and in the consumer app. Watching a rewarded advertisement for a reserve token is always optional and never required to make a purchase or a paid reservation; rewarded-ad grants are limited per day and may be adjusted. Attempting to automate, spoof, or repeat-claim ad rewards is prohibited. Advertisements are served based on placement context (which screen, which machine), not personal profiles — see the Privacy Policy. Pro subscribers do not see ads in the consumer app; kiosk screens are shared hardware and continue to display ads.
Operators license the Puff Geeks platform to run their vending fleet. Platform fees consist of: a monthly operator subscription; a monthly fee per active employee seat beyond the included allowance; a monthly fee per claimed machine; a percentage of NET sales (gross receipts minus collected sales tax and card-processing fees — the percentage is never applied to tax you collect for the state or to processor fees); and a percentage share of advertising revenue generated on the operator's machines. Current rates are shown live in the dashboard's billing preview, which is computed from your actual fleet data. Operators are independent businesses, not employees or agents of Puff Geeks; operators are responsible for their machines' physical siting, licensing, product legality (including age-restricted product rules in their jurisdiction), tax registration and remittance, and their own employees. Operator data access is limited to the operator's own fleet as described in the Privacy Policy. Location scouting and outreach tools: the dashboard includes tools ("Scout") that rank prospective host venues using free public data (such as OpenStreetMap, U.S. Census, and public traffic counts), surface publicly-listed business contact details drawn from a business's own website, and assemble draft outreach messages for your review. These are provided for your convenience only. If you use them, you are the sender of any message you choose to send — you send it from your own accounts — and you are solely responsible for that outreach, including compliance with the CAN-SPAM Act and any applicable state anti-spam, telemarketing, and do-not-contact rules, honoring opt-out requests, and the lawful use and accuracy of any contact information. You agree not to use these tools to send unlawful, deceptive, or unsolicited bulk communication. Electronic contracting: the dashboard includes tools ("Contracts") that let an operator and a venue partner draft, negotiate, and electronically sign placement and revenue-share agreements between themselves. Puff Geeks is not a party to any agreement formed using these tools — the platform provides the record-keeping and electronic-signature infrastructure only; the operator and the venue are solely responsible for the terms they agree to and for that agreement's enforceability. Before you can send, counter, or sign a contract, you will be asked to affirmatively consent to conducting that transaction electronically under the U.S. Electronic Signatures in Global and National Commerce Act (ESIGN Act, 15 U.S.C. § 7001 et seq.) and the Pennsylvania Uniform Electronic Transactions Act (73 Pa. Stat. § 2260.101 et seq.); once given, your electronic signature carries the same legal effect as a handwritten one, and each individual signing action is confirmed separately before it is recorded. Each signature is recorded together with the signer's account, a timestamp, the source IP address, and a device identifier local to the signing browser (not a biometric or forensic device fingerprint). You may download a PDF record of any contract — executed or still in negotiation — at any time from the Contracts tab; that PDF is your paper-copy option and is not limited in any way. You may withdraw your consent to future electronic contracting at any time by contacting us at the email below; doing so does not affect the validity of any contract you have already signed electronically, and you may still be asked to complete a pending agreement on paper instead. VENUE COMMISSION STATEMENTS AND PAYOUTS: where an operator has a commission agreement with a host venue, the platform computes that venue's share from completed sales at the machines assigned to that location and produces a periodic statement, which moves from draft to finalized to paid. Statement figures are derived from recorded transactions, not from manual entry, and a mid-period change to the agreed rate is applied to the portion of the period it actually covers rather than retroactively to the whole period. Payouts are sent through a third-party payment or payout provider, and that provider receives the information it needs to complete the transfer. The commission owed to a venue is an obligation between the operator and that venue: Puff Geeks provides the calculation, the statement, and the payment rail, and is not a party to the operator's agreement with its venue. A venue partner granted access to a machine can see live sales and their own share for that machine only, and that access ends immediately when the operator revokes the grant. MACHINE 3D SCANS: an operator may upload a 3D model of their own machine, captured with a compatible device. Scans are visible to the uploading operator's own fleet and to no other operator. Do not scan in a way that deliberately captures people or customer-identifying surroundings; scans are for equipment. Scans are operator-uploaded content under Section 13 and may be deleted by the operator at any time.
Puff Geeks was built on the idea that we do better by helping each other — "by the people, for the people." To that end, the platform computes aggregate, de-identified statistics (currently: typical restock service duration, and typical effective drive speed) from completed field data across every participating operator's fleet, and uses those figures as a fallback estimate for operators and machines that don't yet have enough history of their own — most usefully, a brand-new fleet's first routes. The following protections are enforced in how the system is built, not just promised in writing: (a) only a single blended statistic is ever produced or used — never your specific routes, travel times, service records, or employee activity, and never a figure that can be traced back to your fleet or any other single fleet; (b) a figure is computed and used only once data from a minimum number of distinct operators, and a minimum number of underlying records, is behind it — short of that floor, it is not produced or used at all, so a thin sample can never function as a stand-in for one operator's real numbers; (c) YOUR OWN FLEET'S DATA ALWAYS TAKES PRIORITY — once your machines and routes have enough history of their own, the platform uses your real, learned figures instead of the network estimate, every time; and (d) this applies only to operational metadata (service time, drive time, stop patterns) — it never extends to your sales, pricing, revenue, product mix, or customer data, which remain exclusively yours, except to the limited, de-identified, and entirely optional extent you may choose under the separate "Scout Placement Benchmark" described in the next paragraph. There is no opt-out from contributing de-identified data to this operational pool, consistent with (a)-(c) above: because no contribution is ever individually exposed, there is no specific disclosure to opt out of, and the benefit is mutual across the whole network. Scout Placement Benchmark (SEPARATE, and OPT-IN): the platform also offers an optional benchmark that helps operators estimate how a machine is likely to perform at a prospective location. Unlike the operational benchmark above, this one is derived from sales-conversion ("capture") rates — how much a machine sells or rents relative to a location's estimated foot traffic — and for that reason it is strictly OPT-IN and carries additional protections: (i) only operators who opt in contribute to it, and only operators who opt in may read it (a fair, mutual exchange); (ii) a figure for any venue category is produced only once a minimum number of DISTINCT opted-in operators and a minimum number of samples are behind it, so no single operator's numbers can be inferred; (iii) only a de-identified category median is ever exposed — never a per-operator, per-venue, or raw value, and no parameter can request one; (iv) your own fleet's calibrated results ALWAYS take priority over the network figure in your own estimates; and (v) you may leave at any time, which immediately stops your data from feeding the benchmark and ends your access to it. This is the one place cross-fleet sharing touches sales-derived data, and it happens only if you affirmatively choose it. You agree not to: circumvent or attempt to circumvent age verification; abuse, brute-force, or automate interactions with the Services (including claim codes, pickup codes, ad rewards, and rate limits); interfere with machines, their software, or other users' reservations; misrepresent your identity or team role; probe, scan, or test the vulnerability of the Services except through coordinated disclosure to our contact email; or use the Services in violation of law. We may suspend or terminate accounts engaged in prohibited conduct and may void program credits obtained through it.
The Services — including software, algorithms, designs, logos, and content, but excluding content you upload (such as an operator's product photos, advertisements, and machine 3D scans) — are owned by Puff Geeks LLC and its licensors and are protected by intellectual-property law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the apps and dashboard as intended by their interfaces. Operators grant us a license to display the content they upload (product photos, ad creatives, machine 3D scans) for the purpose of operating the Services.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-interruption. Machine availability, product availability, demand forecasts, restock recommendations, and route plans — including any that draw on the cross-fleet aggregate described in Section 11 — are estimates produced by software and are not guarantees. Products dispensed are manufactured by third parties; product warranties, if any, come from their manufacturers.
To the fullest extent permitted by law: (a) our total liability to a consumer for claims arising out of the Services is limited to the greater of $100 or the amount you paid us in the twelve months before the claim; (b) our total liability to an operator is limited to the platform fees that operator paid us in the twelve months before the claim; and (c) neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
You may stop using the Services at any time and may delete your account in-app (see the Privacy Policy for what deletion does). We may suspend or terminate accounts for violating these Terms, for fraud or abuse, or where required by law, and will state the reason when we do unless the law prevents it. Sections that by their nature survive termination (including payment obligations, intellectual property, disclaimers, and liability limits) survive.
We may update these Terms as the Services evolve. The version and effective date at the top always identify the current Terms, and material changes will be surfaced in the app or dashboard before they take effect. Continuing to use the Services after the effective date of updated Terms constitutes acceptance. Changes are prospective — they do not retroactively alter completed purchases or already-earned credits.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-law rules, and disputes are subject to the exclusive jurisdiction of the state and federal courts located in Pennsylvania, except where applicable law gives you rights to another venue.
